H1B/H4 Passive investment ?
I am aware of rules regarding H1B from same company as investor but this is regarding as passive investor in different business.
Following are question:
What is Passive Investment by definition for USCIS?
What you need to show in passive investment in terms of money (any paper trail to prove investment)? Do they ask for any proof of investment ? if yes what kind?
Can you be just profit partner (does it considered as Passive Investment)? Does this make you active partner?
What kind of corporate structure you need for passive investment on H1B/H4?
Where My name(H1B)/Spouse(H4) name can be and/or Can not be in terms of passive investment?
- Access to corporate Bank accounts?
- anywhere except as investor?
- In legal contracts with third party as a part of business?
How can USCIS check if you are passive partner or active partner?
What kind of access can you have to profits/money from business as passive partner?
What are the scenario that USCIS will consider as an active role and not just passive?
How can it affect when it comes to Green Card for USCIS? Or what kind of papers or any other proof they can ask to prove that whether I am passive partner or not? or are they any physical audits or physical location check involved ?
I do not want to affect my GC process in anyway and that is why I want clarity regarding passive partnership for either me or my spouse on H4.
I did talk to lawyer and they just ended conversation at passive investment.
