Expired H1 with revoked status and never stamped, can we consider it for CAP-Exempt

Hi,

My brother has Approved H1 but it is revoked due to some personal reasons. Now he want to apply for H1B so his condition comes under CAP-EXEMPT?
can he use the previous H1 and try to transfer it to another company?

H1B validity was Oct 2012 to Oct 2015

any help will be appreciated.

Was it revoked by employer or by USCIS?
