I have a question about my current approved I-140 and being considered for a job with a different business unit of the company I am with currently. My current job which is in chemical engg. field is being eliminated from let's say company A and I am being considered to be hired as a Project Manager (non-engineer job duties) for the business side of the company, let's call it B. The companies A & B are under the same umbrella and are considered sister subsidiaries.
1. I have an approved I-140 with company A and an H1-B that expires end of May.
2. I am being considered for a job at company B mostly to not loose me and to extend my H1-B within the company.
My questions are:
a) With the different job duties involved with CompanyB, is it possible to just transfer my H1-B visa from Company A to B ?
b) If the H1-B transfer can be done, would the green card process have to be initiated for Company B because of the job change (even though it is a sister subsidiary of Company A) ?
