Hello! I am currently on F1 visa. My OPT is valid until 3rd June 2016. I am working for a company and I did not get H1 in lottery 2017. My husband has I140 and I am planning to go back to my home country and obtain H4 visa and then apply for EAD. Since there will be a gap in employment, can I be on leave of absence in H4 until I get EAD? I know that I cannot work on H4 visa but is it legal to be technically employed in H4 but not work until EAD is approved?
