  • H1B visa transfer without Stamping - New Visa first time

    Hello friends, it would be great if you can help me with below query. Below is my case details -

    I work for Company A, in India for past 5 years. Company B, US based consultancy took my interview and after selection, i was offered a job
    subject to H1B Visa stamping.

    Company B filed H1B visa application for me 2016-2017 and it got selected in the lottery. Company B is a small consultancy company in US.
    I dont have any other document from Company B except offer letter subject to Visa Stamping.

    I have the H1B receipt number with me. I have not travelled to US before.


    Below are my queries -

    1. Do i need to wait till my petition comes in approved status?
    2. Can i transfer h1b application to Company C in India, without going for stamping by Company B.
    3. If i dont want to go for stamping via company B, is their any option via which i can transfer the application to a new Company C.
    4. Is it possible to transfer visa to another Company D in US/India, without travelling to US?

    Any suggesstions will be of great help.

    1. Yes. Wait for the approval, join the original petitioner then transfer to another employer.
    2. I don't think you can. It will most likely be denied.
    3. Not until you join employer B.
    4. Visa can't be transferred. It is the H1B petition that the new employer will file for you but as cap exempt. As said before, if you transfer to another employer before joining the original petitioner there is a hig risk that transfer will be denied.
    This is just my opinion, not a legal advice.

      So i can transfer my petition only after joining the company B in US who has filed my initial petition.

      So after joining Company B in US,

      1. after how much time i can ask other Company C for petition transfer.
      2. What documents i need while transferring my petition filed by Company B to Company C.

        H1b Stamping - Suggestion required

        I have a valid stamped visa (H1b) till 20th Aug 2016 in my passport and I am currently in India and recently got my extension approved and an approval notice I-797A came in which it is shown as valid from date as 21st Aug 2016. In this scenario is that I can travel back to USA with my existing stamped visa in passport and after 8/20 the newly approved I-797A will come into effect ?

        At present my family is USA and I came to India after my existing extension is filed and after coming here I have it approved and I-797A approval notice came.

        Can you please let me know if there will be any problem ? or any suggestions on how to take the above situation.

          So after joining Company B in US,*
