My H1b visa is valid till December 2016 and the extension is not filed yet. My wife needs to travel to India around October end and will be returned by Feb end. We have never been to India since we came here(August 2013).
Details: 1) Visa extended thrice since it expired in Sept 2013
2) Changed my Employer in Aug 2014
3) My I140 is pending as well.
Question:
1) Can she travel if her extension is pending(Hopefully my employer will file my visa extension by that time)?
2) Do i have to be with her for stamping in India? I cannot travel because of some work commitments.
