When I can start working when applying for H1B?

  • When I can start working when applying for H1B?

    I'm currently on a valid L1B visa that expires in 7 months. Let's say I find a new job tomorrow. I heard that you can apply for H1B only in April. So, I have a few questions:
    1 - Can the new employer file for H1B visa now or he has to wait till April?
    2 - If the new employer doesn't have to wait till April, when I can start working for that new employer?

          There are certain category of employers such as Govt bodies, educationalinstitutes, non profit which are considered cap exempt. They need no go through yearly cap to bring an employee on H1. An employment for profit organization needs an H1 which is cap subject. H 1 cap for this year is already over
          The next cap will open April 2017 for a start date of Oct 2017.
