Hello everyone,
I am on H1B visa working in Chicago. I will be going to India for my visa stamping in December. I have started filling out the DS 160 as I want to book my appointment date ASAP. I have a question regarding what to answer for
"Has anyone ever filed an immigrant petition on your behalf ?" My labor is approved, but my employer has not filed for I 140 yet, looking into other answers in this forum I found out that you need to answer yes if they have filed for I 140, but for me my employer will file for I140 next month and I am going to complete the DS 160 and get an appointment date before that.
Please someone let me know if I can answer No for the above question since my I 140 will be filed on a later date after submitting DS160 but before going for stamping.
