Thru my current employer (A), i got H1B visa and spent around 4 years in USA.
Last year, i returned to India due to my personal reasons.
Right now, i am in Offshore (India) location working for the same employer for the past 8 months.
My I-94 got expired 4 months back and I did not initiate the extension or renewal process due to family reasons.
I am aware that i can initiate the extension thru " Not-subject-to-Cap " option anytime later, while i work for the same employer.
Question is about portability of H1B visa in India.
Recently i got an offer letter from an Indian company say B to work in India. (initially for 2 months)
The new employer may send me to US for a short term sometime later.
1) Can H1B visa tranferred in India after i join the new company ?
2) Will the new employer be able to initiate the petition/visa under " Not-subject-to-Cap " option ?
Pls share your thoughts.
