I am currently working in a company X in H1B status and I have the I-797 approval notice for both myself and my wife. Currently my wife has traveled to India due to emergency situation. However due to some changes in my work I have to change my company and transfer my H1-B. Can my wife get her H4 Visa stamped with current I-797 and enter US even though by the time she returns I may have probably changed my employer?
Or does she has to have the new I-797 and the Visa stamped based on that? Can someone throw some light on this.
