I have a confusing situation with my visa. Hoping to get an answer here. Here is a summary of my situation:
-I was on a short term H1b which had an expiration date of 5/31/2016. The expiration date on the I-94 was the same.
-Applied for a change of status to H-4 before the end of May and USCIS sent the receipt notice. The case is still being processed.
-I got a new job offer from the same employer with a start date of September 1st and they are willing to apply for H1b again (or extend it) and also do premium processing. The paperwork is almost done.
My concern is if we have to wait until the change of status is approved to apply for H1b or it can be done while the change of status is pending?? I heard from a customer service representative at USCIS that I should first withdraw the change of status and then apply for H1b extension, but I don't know if that would be possible since my I-94 has expired on May 31st and as far as I know if I withdraw my change of status application I will be out of status and need to leave the country. Please note that I am looking for a way to get my H1b without leaving the country.
