  • H1 transfer to multiple companies

    hi gurus, Kindly answer this simple question. for you it must be simple im sure.
    I applied for H1 transfer from A --> B and A --> C simultaneously.
    Both petitions are approved. So now I can join any company.
    Question: As soon as join "B" then the A --> C approval will still be valid or it will be totally null and void ? I cannot leave B and join C ?

    thanks

    You cannot just join C after joining B and then resigning from B. Post joining B if for some reason you want to join C, you need to refile the I129 and get it approved in order to join C.

    This is my opinion not legal advice.

      Hi Raghvi, thanks for reply. I129 is not actual H1 transfer petition, it is an amendment , am I right ?

          hi Raghvi,
          so it does mean that the company C will have to go thru the entire process what they did for my transfer from A --> C again , this time from B --> C
          so I will have to give them paystubs for B ?

          thanks

            Yes. Paystubs from B will prove that you are in a valid status.
