I am currently in my 6th overall H1B year. My previous employer A extended my H1B until 2018 with an approved I-140. I have left employer A and joined a new employer B after they submit H1B transfer petition (still pending). Employer A may withdraw the I-140 at any time. What happens if the H1B transfer to employer B is unsuccessful? Would employer B be able to try again and file a new cap-exempt H1B until 2018, even if I-140 is withdrawn?
