Hi,
My initial stay in the USA was on a L1B visa. During this time, I filed a H1B visa with a consultant, but since this consultant wasn't able to get me good jobs, I never switched to this consultant, and continued my stay in the USA on my L1B.
Current Situation:
H1B - No stamping done on this, and is now expired. H1B was valid until 30-Sep-2014.
L1B - Expired, and hence not in the USA anymore
In order for me to get back to the USA:
1) Am I eligible for out of cap processing based off the above?
2) Can I file an out of cap H1B with a different employer on this expired H1B?
Can someone please let me know the answers to the above?
