I am planning to travel during the first 2 weeks of September due to a family related reason. My EAD expired in July, but I am under the cap-gap extension with an approved H1-B. The status changes on October 1, and I am planning to be back by September 17, 2016. My F-1 is valid till 2017 and my passport is valid till 2022.
My question is - Will I be able to return on my F-1 VISA which is valid till May 2017 under the cap-gap extension? I do not plan to get my H1-B stamped until December, 2016 during my second trip home. I am afraid that an expired EAD may cause issues.
Both my international student adviser and the HR (Immigration) person at my company feel that it is safe to travel with an approved H1-B. I am hoping to get some input from H1-B holders or lawyers who have experience in this particular case. I plan to call up USCIS tomorrow to see if they can provide any guidance.
