Hi , My husband's 140 is approved but his visa is maxed out and is currently under extension. I am planning to switch to H4 and apply for EAD. Can I start the process even before he gets his visa extended, based on 140 or would I have to wait until he gets his valid 797? Can we file for status change independently or does his company has to file one for me?
