H1B in Consular Processing while H1B Transfer
Recently get filled H1B visa transfer to BBBB company, for my current H1B visa (valid till Sep 30, 2016) employer AAAA received Intent to Revoke Notice and AAAA company filled withdrawal for that. And with AAAA company has amendment, which is RFE stage (AAAA company is planning to withdrawal too). My current I-94 is valid till Sep 30, 2017
Now on my H1B transfer petition received RFE. In RFE USCIS is asking, submit a approved copy of Amendment Petition to approve transfer petition(which we can't submit, as it is currently RFE). Additionally asking for the Embassy details, where the beneficiary will apply for his visa if USCIS is unable to grant the beneficiary a change of status.
If my transfer petition approved in "Consular Process" based on current position :
1. How much time I will get, for go out of country to get stamped visa and come back ? Do need to go entire family (having I-94 till Sep 30, 2016) out of country OR only me is enough ?
2. Can I stay as I am having valid I-94 till Sep 30, 2017 ? If yes, family need to go out of country and come back with valid stamp ?
3. If I need to go stamping, can I go near countries for stamping or need to go only India as it my home country ? If near by countries, which country is best for smooth process ?
