I am in following situtation:
1. Company A applied for H1b, application approved for Change of Status on October 1, 2016
2. Working on Cap Gap OPT for Company A while got Laid off
3. Due to lay off got more than 90 days of unemployement on OPT, thus F1 violation
4. Still staying in country 20 days past the violation, I94 has D/S
5. Got a new job and have to transfer H1 to the company B
I have been asked to select from Change of Status or Consular Notification. What you be my best bet in my case and what are the complexities I should consider?
