H1 B Transfer while H1 Extension pending but Valid Visa and I -94

Hi All,

Here is the situation - My visa is expiring on 8/31/16 and I-94 on 9/9/2016, and my current employer has filed extension and amendment on 7/15/16.

If my new employer is filing H1 B transfer on 8/30/16, would it be a bridging scenario or normal one, since my new employer is filing it before my visa expiration/ I- 94 expiration.

I also same situation.


My current visa is valid till 1st Jan 2017. My Amendment and extension has been filed three months before for the location changes. It is still in case received status.

I am planning to travel next week and will come back on 1st Oct ’16 with my family.

Please advise, will there be any issue on port of entry in US.

My current employer has filed my extension in normal processing whether new employer has filed in premium.

H1B transfer when H1B Extension and Amendment is pending

Currently I am working for location A, Role as software tester for Employer A. Current H1B I-129 and -94 is valid until 30 SEP 2017 for this location and role. After March 31st, I am going to move new location B for same employer A and new role as computer programmer. Employer A will file amendment for role and location change & extension since I-94 is going to expire in next 6 months.

I have another employer B who will be filing my H1B transfer around May end. I am afraid & worried to do transfer to Employer B when Employer A extension & amendment is pending.

In this case, Employer A will do H1B extension as well as amendment for new location B and new role as computer programmer. My current petition and I-94 which is valid until 30 Sep 17 is approved for location A and software tester role. When employer B file transfer in May, I will be working for employer A at location B but transfer to employer B will be filed using original petition which is valid for location A.

Please advise
