  • H1B stamping interview without I797A

    I have a bit of a situation:

    { TL;DR
    I have my visa appointment coming up in a few weeks time. I have my 1-797C with me but not my I-797A. In fact it never got delivered to my employer. Do you think it is okay for my to go ahead with the interview? }

    My H-1B case got selected in lottery this year in April. My case also got approved.

    In May I had to fly to India for a family emergency. My employer said that I can take leave of absence and join back at work after getting my H-1B stamped in October.

    My employer said that once my I-797A gets delivered at the office, they will mail/scan it to me. However, my I-797A has not been delivered yet. Two attempts have already been made and my employer has requested for a duplicate. Each time it has taken a month for any action to be taken.

    So, despite this I went ahead and booked an appointment at the US Consulate because getting a decent date was difficult. And the only way for me to join back work is if I get my H1B stamped. My visa interview is in the end of October.

    I'm really hoping that by then they will receive the I-797A. But what if I don't?

    Right now I only have a copy of the I-797C. Although, the contents of both I-797A and 797C are similar I suppose: case number, petitioner name, beneficiary, dates etc.

    Has anyone had a similar situation where they had to go for the interview without an I-797A (not even a photocopy) and just the I-797C? Any help/suggestion is appreciated
