L1B to B1 visa to cap exempt H1B

Hi,

Here is my current situation. I am with company "X" on L1B and is in in US currently. A cap exempt company "Y" wants to file a H1B for me.

My current company "X" might send me back in a month to India, while the H1B processing is still in progress.

Questions:

1) - What happens to *H1B while COS is still in progress.*

* * * * * a) Does it gets totally rejected or it gets automatically routed to consular processing ?

* * * * * *b) If I return back to India, can I still get it stamped there and come to US on H1B using consular processing ?

* * * * * *c) in case if*COS gets abandoned, and I am back to India -*will a fresh petition needs to be filed for new H1B case ?

2) I also have a valid B1 visa.*

* * a) Can I move to B1 from L1B *before my H1B filing starts*?

* * b) If answer to above is yes , Can I move to H1B from B1 next**?



3) what happens under a premium processing *-*

* *a) Does USCIS only gives a decision whether a petition is approved/disapproved or the actual COS can also happen with 15 business days ?
