  • Is h1b transfer to an employer possible

    Hi,
I have travelled to US on H1B visa from my ex employer who initiated my h1b process.
Following are my details of visa and passport.

US Entry Date: 29th Nov 2011
US Exit Date: 11th Feb 2012
Passport issue date: 12th Mar 2008
Passport expiry date: 11th Mar 2018

Could you please let me know if my h1b can be transferred to an new employer now or in future?

    Thanks in advance.

Any unused time on your h1B can be reclaimed by a new employer within 6 years of your original visa issue date. Since you travelled in 2011 I am not sure when your visa was issued. If your visa was issued in 2011 jan, your new employer has until Jan 2017 to apply for a transfer. Once 6 years pass, you lose the ability to utilize the unused time and will be forfeited. You have to get a new H1B and go through the lottery system again.

          Thank you.
In my stamped H1B Visa, Issue date is Nov21, 2011 and Expiration date is Oct 13, 2012.
In such case till Nov 2017 it can be transferred and can be used.

Let me know If I am wrong??

Correct. Also look into your passport renewal. You can renew it 1 year before expiry. You need at least 6 months validity on your passport when you go for stamping(once your transfer is approved and you set an interview date)

Thank you very much for sharing the critical info.
As mentioned below, my H1 visa will expire on Nov 2017 and my passport will expire on Mar 2018.

I didn't understand what you say below
"Look into your passport renewal. You can renew it 1 year before expiry"

Since my h1 is expiring before passport expiry date, so I can plan my passport renewal post passport expiry date.

              Please confirm If am right?
