I was on F2 visa prior to 1st october,2016. And since my husband H1-B visa is in status since october 1st 2016 I needed to file for h4 before 1st october which we were unable to file due to some problems. My question is since I am out of status , do I need to immediately go to India to get h4 Or I can file for h4 after 1st october while being in USA?
