I'm in a situation where my dependents H4 has expired and it has been 2 weeks now. I do hold a valid H1 status.
I have the following questions:
1. Can we apply H4 extension now while there are in US. Will that be a safe option?
2. What if, if we applied the H4 extension and we did not heard anything back until 6 months or more. Will that be considered as illegal stay ?
3. What are the consequences say after 6 months the H4 extension was denied. What options do we have to come back to US with valid H4 status.
4. While H4 extension has been filed can we do a H1 transfer? If yes, after my H1 transfer can I apply H4 extension on the new employer i.e. second H4 application.
5. Is it better to go back to India and get the stamping again and enter US with valid status. Provided we have all the documents in proper, could there be any case where they can reject H4.
