  • H1B Transfer

    Hello All,
Please help me ASAP. I got my new H1B approved through Employer A on 10/11/2016. I was on OPT Extension previously and my contract was ended in April with Client X through Employer A. Since then, i was on bench and my employer was running a payroll just by paying taxes but the Net Pay is 0. Now i got a new full time opportunity. What are my options to transfer my H1?
1.My new H1b got approved on Oct 11th, do i need to provide past 2 months pay stubs for H1B Transfer?
2.As i don't have proper pay stubs, will that be an issue fro H1B transfer?
3.I have pay stubs with Net Pay 0(Only taxes were paid), will that be an issue if i submit them for H1b transfer?
    4. What are the possible solutions, so that i can transfer my H1b without any issue?
    5. Do i need to intimate my Employer A about h1b transfer?

What do you mean by 0 net pay? Your employer has to pay you even if you are on bench. Since you are not being paid, you are not maintaing a valid H1 status and your H1 transfer will most likely be denied. You should file a complaint to DOL about your employer not paying you and should leave the country asap to not accumulate your out of status days.
This is just my opinion, not a legal advice.

I'm not on H1B status till last week, as my H1b got approved couple of days back. I'm on OPT EAD when on bench and my H1B got approved on 10/11. Do i need to still submit last 2 months pay stubs to transfer even though I'm not on H1B status before?
