  • H4 Visa Stamping when Primary visa holder is on leaves for more than 2 months

    Dear all

I have approved H4 EAD in USA, i am planning to go India for visa stamping, Primary (h1 applicant) has already got the visa stamped, but however she is on long leaves from last 2-3 months and hence i will not have recent pay stubs to produce to consulate if asked for it.

Will there be any issues if recent pay stubs could not be produced (for 2.5 months) , also primary visa holder is still in india.
what other supporting documents shall i take to cover for pay stubs.

Is it advisable to go for stamping?

    Thanks

Where is the primary applicant right now? Assuming she is in US, what kind of long leaves is she on? She has to be paid during all the time to maintain a valid H1 status. If she is not being paid, she is out of status and your H4 stamping or entry at POE will be in trouble.
This is just my opinion, not a legal advice.
