Long story short I accepted an offer from a startup earlier this year, got the H1B petition and visa approved, also got the H1B visa stamp at the consular from my home country but I haven't activate the H1B yet.
Currently I working in their remote office reside in a country outside of the US.
But the company is going through a financial hardship, so they tell me they'd need to defer my transfer to the US until further notice. I want to see what is my option here. If I accept an offer from another company, do I still need to go through the petition and subject to the quota cap? Or could they transfer the H1B to their company?
