Hi,
When I am filing H1B extension, I filed H4 for my son and husband in April 2016.
My visa got approved in Jun 2016, My husband visa got denied bcoz he didn't complete the initial stay(120 days) in US.
Under the same I-539 , I have applied for my son also, Still this petition is in processing from April 22- 2016.
If I didn't get approval before jan 30th his 240 days with receipt number will get over. is it necessary for him to move out of US or can he stay here with my valid visa. (My son is 6 years old)
Is there any chance to get any legal problems ? does anyone faced this situation?
