Can I apply for my H1-B visa extension from India?.I-94 expired already
Hi,
I came to US on April,2014. My Visa was valid till July,2016 and the same with my I-94 validity. My employer filed my extension on May,2016 and my case is not approved yet. Meanwhile my project which I was working has been shut down due to unavailability of funds. However I got a project with different client in another location but my employer is asking me to go back to India as they cannot file an amendment for relocation while my Visa extension in progress.
My question is
1. Can I file for a Visa extension plus amendment after going back to India if I get my next assignment confirmed. Also can we do a Premium processing on that?
2. Should my employer has to withdraw my current extension request which is in progress once I go back to India.
I could see a lot of similar posts but they are older. I am posting this anticipating any change in the immigration rules recently.
