  • H1B Extension pending with Vermont center from more than 10 months

    Hi,

    My H1B Extension pending with Vermont center from more than 10 months, in regular processing don't they have any SLA?
    My previous H1B approval is expiring soon with in few days, do I go for premium processing now?
    I know there is some 180 days window after I-94 expiry where I can legally stay in US.

    Any advise from seniors?

      No, attorney says its not required as still my case didn't passed the Vermont center processing dates.

        If you do not overstay by 180 days or more, it shouldn't trigger any automatic ineligibility. That doesn't mean that you are guaranteed entry into the U.S., or won't be asked about the overstay if you try to come to US again when you go to India. Not sure how this overstay might also impact your GC. Check with the Attorney.
