H1B (with no payslips) to H4: Risks in future
I am on stamped H1-B visa (through a consultancy) for 13 months but unfortunately, did not get any projects. So, I do not have payslips or W-2.
Reading all around, I am planning to convert to H4 now. I already have valid H4 petition through my husband’s H1-B, just need to go for stamping in India (that’s what I am planning instead of COS while in US) and enter USA on H4.
I have few questions while I am changing visa to H-4:
    • Any suggestions what should I talk to my employer (e.g. Showing personal leave for whole period of H1-B)?
    • If, during H4 stamping process, question on my H1-B comes up, what is the appropriate reply for having no payslips?
    • How would I not paying taxes (no pay slips on H1B) can affect me now or in future?
    • How would I not paying taxes (no pay slips on H1B) can affect me now or in future, in case I get H4-EAD?
    • Would any of the above affect my husband while he files for Green card next year?
I guess there are few people who have/had same situation – any personal experiences or feedback are appreciated.
    Best Regards,
    Mini
