Hi All
Im working for an employer X and H1 B extension is in progress in the employer X and I have got RFE and responded back to USCIS. This H1- B extension, I have applied in premium in the employer X, Also my existing H1-B petition in the employer X is valid until July 17.
At this moment, Current H1 B extension in employer X is under pending state after the RFE response back to USCIS.
Note: I have approved I-140 in the employer X, and it has approved more than 8 months back.
Question:
1. I have an offer in employer A now. Which H1B petition do I need to submit to the employer A for transferring the H1 B ?
2. OR Do I need to wait until the H1 B RFE approval should get from USCIS through the current employer X to proceed further with the H1 B transferred to the Employer A?
3. If incase if my employer X revokes the H1 B extension without my notice, the transfer to the employer A will get affected ?
Please can you help me out.
