H4 to H1 Change of Status
Hi all
am looking for some expert advice from this forum on my visa statuses here, considering present situation in the US.
Am in India and never traveled to US. My h1b petition got selected in lottery in 2016 and was approved. I didn't go for interview yet. Meanwhile, since my husband is in the US on H1, I got my H4 visa before my h1b is approved.
My question -
1. Can I travel to US now on H4 and can my employer file a COS from H4 to H1? How long it would take? Will there be any rejections in the COS? OR
2. Is getting my H1 stamping in India and entering US on H1b is safe?
I also hold a Canada work permit visa from my current employer ( not same as my H1b employer). Considering the rejections in H1b, do you suggest taking up the Canada opportunity instead of USA?
