Can dependent travel on H4 whereas his H1B is also going to applied on April ?

Hi Team,

My wife is working in US in H1B & myH1B is also going to be applied on April'17.
I am willing to travel on H4 for 21days on the month of may/june'17, but my H1B also will be in process(lottery & all), will it have any issue? Can you please help me in this.

As far as my understanding, I can't have 2 active visas at one time - but unless H1B stamping happens, is it considered an active VISA when the H1B application is under progress.

Should you be successful in the H1B round (no lottery this time), then you will get that status from 1 October. Until then you have to maintain other valid status and your current H4B is fine for reentry.
