H1B visa approved in US and transfer without Stamping in India
Hello friends, it would be great if you can help me with below query.
Below is my case details -
I went to USA on L1-Blanket from Company-A, then Company-B filed H1B visa application for me in 2016, it got selected in the lottery and petition got approved then I joined Company-B on 01st Oct, 2016.
Due to some family urgency, I had to come back to India and now I am not returning back to USA and have to find job & settle down in India only and joining Company C.
Below are my queries -
1. Can Company-C transfer my H1B petition in India, without going for stamping by Company-B?
2. If Q1 is yes, Company-C says they will initiate transfer only after I will join them. If I resign from Company-B, can Company-B can cancel/revoke my H1B petition?
3. If Q2 is yes, even after Company-B revoke my petition, can Company-C file new petition or transfer old one? Will that be in CAP limit?
Any suggestions will be of great help.
