My company sponsored me in the H1B lottery this year but I haven't received a reply (I'm assuming this to be not selected at this point). The company has now opted to submit an H3 so that I can continue to work and train to work for a sister company based outside of the US at the end of the H3 visa. My OPT expired at the end of May but I was told by the lawyer that because I had not received a decision on the H3 and the H1B, I am allowed to continue work until I am told otherwise. USCIS have now come back with an RFE on the H3 that is not due a response for a number of months.
Some of what I have read online is making me suspicious that I am actually not allowed to work. Is the lawyer correct in saying that I am able to continue work until I have received a denial on the H1B and H3 applications?
