My Situation:
Employer A sponsored a green card for me. I got I140 approved.
I joined employer B which filed an H1b extension for me beyond 6 years based on approved I140 from employer A.
Employer B hasn't started GC process yet. I understand employer B needs to file Labor and I140 again but I can maintain my priority date from Employer A.
Now, I am planning to quit current employer (B) and return to India. I want to go to India and stay there for 3 years. In these 3 years, my current H1B visa with employer B will expire. After 3 years, if I want to return to USA, if I am able to find a new employer to file H1b for me, will I be eligible for H1b extension wihtout cap based on approved I140 from employer A ? While I am in India, even though I dont have a valid H1B visa(expired I94) and I have maxed out 6 years, can I still get request H1 extension based on a old approved I140 ?
