My company was trying to hire a person for their role for about 8-9 months and finally found me. Now they try to transfer my H1B. My H1B just got approved this year and currently I am Cap Gap.
If they want me to start on late August, I know there is a risk.
However, if they try to file expedite request for my case stating "Severe Financial Loss to Company", do you think this qualifies for this category given the fact that they need a person to start this job asap because they cannot find a person for about 8-9 months?
