Hi All,
I am under OPT extension(expiring in Dec 2017) and have filed H4 EAD under my husband(He has H1B and got I-140 approval) 3 months ago. Now my husband wants to change job from Company A to Company B, and start H1B transfer. However, my H4 EAD are still pending and all I have are the receipts. Questions,
1. Is it required by law that Company A has to withdraw my husband's current H1B after he leaves?
2. Will it cause issue for my pending H4 EAD applications, if Company A withdraw my husband's H1B before I get H4 EAD approval? If so, what is the best way to deal with it (assuming changing job is a must for my husband)?
3. Just to confirm that Company A cannot withdraw I-140 after 180 days of approval, correct?
