Urgent H4 to H1
I'm on H1b1 status holder and on 7th year of H1B and getting yearly extension base on
a labor certification filed on behalf which is pending with the backlog center.
The H-4 spouse will be completing 6 years on H classification in july 2006. The H-4 spouse would like to change her status to an H-1B. She has no labor that was filed on her behalf prior to 365 days. will he/she eligible to get H1B? OR
Will she be eligible to get an H-1B based on her husband's labor?
Help needed asap.
