Hi all,
Here's my situation. Currently I am on H1-B. My 6 years would be done in OCT 2019. I was going through Green Card process but my PERM got rejected so right now I need to find new job and start the GC process all over again. I am not sure if I have enough time to get to I-140 applied or approved step to get further extensions to H1-B. If everything goes smoothly I might happen but here I want to discuss the worst case scenarios to start preparing for it while I am time.
In case in OCT 2019, I don't have my application in fro I-140 or have it approved, what are my options.
1. Can I go back to school and switch to F-1 status and get another OPT after completing my study. [I have already utilized OPT and OPT extension for my Master's degree]
2. Do I need to go for higher degree than Master's (Phd ??)
3. After finishing study can employer apply for H1-B again or I still need to spend a year out of USA?
4. Can I get another H1-B without going back to school or Staying outside USA for a year. is that even an option?
Thanks for your help.
