My H1b processing is still pending and my F2 status is about to expire!!

I am currently on F2 visa. My husband got his H1B approved and its valid from October 1, 2017 where as my H1B processing is still pending.I will be out of status post october 1, 2017. Our attorney asked us to wait till we hear an update on my H1B. If it is denied then immediately apply for change of status to H4. Please advice how to proceed with this.
