Hello,
I am currently on a cap exempt H1B that is valid through June 30, 2018. I have a job offer that will start in July 2018, and they don't sponsor H1B. Because my spouse has I-140 approved, I was thinking of getting a H4-EAD for my new job.
My spouse's H1B will expire in April, 2018 and so their employer will be submitting for H1B renewal in a week. Can I apply for H4 and H4-EAD right now (approximately 9 months before my H1B expiration), with a starting date of July 1st, 2018? Or does my current H1B add any restrictions on when I can apply for H4/H4-EAD - I am told that I cannot apply until "6 months before H1 expiration date" - Is it true?
