What is the validity of work permit when out of cap H-1B visa transfer is in progress?
Currently I am on OPT. I have worked in USA earlier on H-1B for couple of years. Later, I enrolled in Full-Time masters program and applied for OPT. My OPT is about to end in Dec 2017. My employer is going to file out of cap H-1B transfer to utilize the remaining time period of the H-1B. But employer is not using premium processing option for H-1B transfer.
Following are few of my questions:
Am I eligible for Cap-Gap Extension? ( Given that mine is not a new H-1B application but an H-1B transfer)
Will I legally be able to work when my OPT ends and out of cap H-1B transfer is still under progress?
