Here is the situation: I got my H1-B approval in April 2006 after I changed my jobs in November 2005. I'm also beyond the 6th year of H1-B. Due to the lawyer's error, my wife's paper work was not filed in time. Her application for extension under premium processing was rejected. We cannot wait for the approval through regular processing times as she would be past 180 days.
Can we request for an emergency appointment in any of the Indian consulates if we travel to India right away. For emergency appointments, can a resident of AP go to New Delhi for appointments?
The website says that any H or L renewals to return to jobs back in US will count for emergency appointment and they encourage that H1-B holder and dependents appear together.
Any help will be greatly appreciated.
