Laid off while H1B extension in RFE
Hi Friends,
In a very difficult situation as below.
Visa/I94 expired in June, extension timely filed.
Got into an RFE and will be responded and converted to premium this weekend.
Employer said last day may be 15th if no project is available.
If I get the approval by say 25th,
1) Is the approval worthless since I am no longer working with the employer?
2) Will I be out of status ? Also will I accrue unlawful presence for nearly 5 months(from Jun onwards) , since my petition has been pending since June and I am no longer with the employer?
3) Can any other employer file a new petition with the approved petition/I94 ??
4) Any grace period?
What are my options??
