Hi,

This is a special case. My petitioner has applied for my H1 visa. I have got a 229(g) and it is in administrative process. I'm told by the consulate (in the interview) that it is either going to approve my visa or reject it (no further interviews).

I now found out that the intentions of my petitioner are not good. I donot want to work for him. If my visa gets approved then I will have to work for him unconditionally as per the contract signed. I will have to pay a huge amount to break the contract.

Is there any way so that I would request the consulate to stop processing my visa or to reject my visa!! Can I apply for withdrawal of pitition beeing an employee (alien) or is there any other way

Need urgent replies.

Its better if U directly contact Chennai Consulate (mail: [email protected] ) about process of withdrawing ur petition for h1b/h4. They know more than us.

I don't know you can stop processing & how fast that process will be. But all that contract is not valid in USA. So if u break contract, you don't need to pay any money in USA/India (I have gone through this & fight & won my case in court)...So come to USA, if u don't like current company , find other company & transfer ur H1.
