My wife just entered the US on H4 visa. However, she has an approved H1B petition valid until 2008. This H1 was processed and approved in 2005 when she was in India and has no I-94 attached on it.
Can she start working on H1B, although her current I-94 received on entry into US shows her status as H4? Does she need to stamp the H1B prior to start working? If so, can she do it at any US consulate? USCIS had processed the H1B with Chennai as the foreign consulate.
Please help if anyone has enountered a similar situation. Thanks.
