  • PERM and i140

    Hi,

    My 6 years of H1 expires at october 2018. My PERM was filed first week of aug 2017 with employer A. Then Employer B acquired Employer A, Employer B were still good and took over my H1 and told they will take over my i140 and bring it closure. As of today, I checked my PERM status and it was in-progress. However Employer B fired and shut us down (with the exception of myself). With the following instance, what would happen to my existing approved PERM?
    1) Will i still qualify for the 365 day rule, where I get 1 more year under my H1 of Oct 2019? (Considering Employer A does not revoke my PERM?)
    2) With Employer B, am currently under FMLA - which technically gives me until mid of Feb 2019 (Past that would be fired).

    Which would be a better option for me
    1) Try to find a new employer who can do my PERm and I140 altogether ( 11 months left on my H1 visa )
    2) Talk to existing employer B and try to get i140 done?

    Please advice....
