Hi,
I've have a valid H1B visa until Feb'2020 and in Jan got my petition approval for current company and location 1 until Feb'2020.
In May, i had to add a new location (location 2) for which i filed for an amendment. This amendment was for the same client but for 2 location (location 1 and location 2). It went under RFE and then was denied.
Wanted to understand if the extension which i got for location 1 is still valid and i can work for the same company and client still from location 1?
I checked the USCIS link for the "last action rule" and found the below:
If your amended H-1B petition is denied, but the original petition is still valid your H-1B employee may return to the worksite covered by the original petition as long as the H-1B employee is able to maintain valid nonimmigrant status at the original worksite.
The original petition here refers to the approval i got in Jan or is it the one before that?
Regards,
Sid
